The country's first Corporate Manslaughter case is going through court at the moment. The defendant company and , particularly, its director face proceedings for gross negligent manslaughter over the death of a young person in 2008.
The company faces an unlimited fine and the director, who is charged with gross negligence manslaughter, faces a maximum sentence of life imprisonment.
The case highlights the need to ensure that your Employers' and Public & Products Liability cover is extended to indemnify you in respects of your legal costs and expenses to defend any criminal proceedings for any offence as defined in Section 1 of the Corporate Manslaughter and Corporate Homicides Act 2007.
